Update: Innovation Direct™ receives reply from licensee of trucking accessory with update on status of invention…
Hello, Juan C. Blanco, Innovation Direct™’s Director of Product Licensing, checking back in with an update on a situation we had just reported on in an entry yesterday (“Innovation Direct™ attempts follow-up with California-based licensee of trucking accessory…“). Earlier Tuesday, the Innovation Direct™ representative that had e-mailed the California-based company that was the subject of that posting requesting an update on a previously licensed trucking accessory received a reply from the president of the outfit. Per the correspondence received, the product never went into full-scale production because of intellectual property concerns.
As the e-mail went on to explain, the manufacturer had received the results of a detailed patent search that an independent patent attorney had conducted shortly after the licensing agreement had been executed and had found that there had been a number of similar patents obtained in the past. While there were still opportunities to attempt to differentiate the invention’s design sufficiently so as to render it patentable itself according to the patent attorney’s opinion at the time, subsequent conversations that the licensee had with some of the other patent holders led to him to conclude that there was not a sufficient market for this general type of product.
We are certainly disappointed by this outcome but did mention in our reply to the licensee that if they ever decided to reconsider the further development of the product they should make us aware.
